OF USE.

These Terms of Use (“Terms”) form an agreement between you (“User,” “you”) and EXPLR PBC Inc. (“EXPLR,” “we,” “us”) governing your access to and use of the National STEM Festival websites, platforms, services, and applications (collectively, the “Platforms”). By using the Platforms, you agree to these Terms. If you do not agree, do not use the Platforms.

1. Acceptance of Terms & Changes

We may modify these Terms from time to time. Your continued use of the Platforms after changes are posted constitutes acceptance. For material changes, we will provide at least 30 days’ notice to your registered email (if available). Where personal data is impacted and the law requires it, we will seek your explicit consent.

2. Copyright Notice

All materials on nationalstemfestival.com and related EXPLR domains (the “Website”) are the property of EXPLR unless otherwise stated. Any reproduction, distribution, public display, or adaptation of content is prohibited without our written permission.
You may access, download, and print pages temporarily for personal, non-commercial, or educational use only. Downloading or scraping of video content from the Website, EXPLR platforms, or EXPLR social channels is not permitted.

3. Accuracy & Use of Content

We strive for accurate, timely information, but we do not guarantee that content is error-free or fit for any specific purpose. Users should independently verify information. All materials are provided for educational and informational purposes only.

4. Children’s Privacy (COPPA – U.S.)

The Platforms are not intended for children under 13. We do not knowingly collect, use, or disclose personal information from children under 13 without verifiable parental consent. If we learn we have collected such information, we will delete it and terminate any related accounts.
If you believe a child under 13 has provided personal information, contact hello@explr-media.com immediately.

5. Parental Rights & Responsibilities

Parents/guardians who suspect their child under 13 has registered or provided personal information should contact hello@explr-media.com. Upon verification, we will promptly remove such data.
Terms of Use apply to the National STEM Festival Website. For Student Submissions, please refer to the Student Terms of Service (linked where applicable).

6. Privacy & Data Protection (Global)

Your use of the Platforms is also subject to EXPLR’s Privacy Policy, which explains what personal data we collect, how we use it, and your rights. If these Terms and the Privacy Policy conflict, the Privacy Policy controls regarding personal data.

Controller. For the Platforms, EXPLR PBC Inc. is the data controller. Contact: privacy@explr-media.com or EXPLR PBC Inc., [Postal Address].

Jurisdictional scope. Depending on where you live, additional rights/disclosures may apply under:

  • EU GDPR (EU/EEA) and UK GDPR (UK)

  • CCPA/CPRA (California) and other U.S. state privacy laws

  • LGPD (Brazil), PIPEDA (Canada), and other national/regional laws

We honor applicable local rights.

Lawful bases (GDPR/UK GDPR). We process personal data on one or more bases: consent, contract, legitimate interests, legal obligation, or vital interests.

Your rights. Subject to law, you may request access, correction, deletion, restriction, objection, and portability; and where processing is based on consent, withdraw consent at any time. Submit requests to privacy@explr-media.com. EU/UK users may also contact their local data protection authority.

Do Not Sell/Share (CPRA). We do not sell personal information. If we “share” personal information for cross-context behavioral advertising, you can opt out via the “Do Not Sell or Share My Personal Information” link (where required by law).

Children & age thresholds (outside U.S.). While COPPA governs under-13 in the U.S., some regions set digital consent between 13–16. We will obtain parental/guardian consent where required and restrict features that collect children’s personal data without proper consent.

International transfers. When transferring personal data internationally (e.g., to the U.S.), we use safeguards such as EU Standard Contractual Clauses (SCCs) and, where applicable, the UK IDTA/Addendum.

Marketing communications. You can opt in/out via email links or by contacting privacy@explr-media.com.

Data retention. We retain personal data only as long as necessary for the purposes described or required by law, and then delete or anonymize it.

Security. We implement administrative, technical, and physical safeguards appropriate to the data we process; however, no system is 100% secure.

Vendors & subprocessors. We may use service providers under written agreements requiring appropriate privacy and security protections.

EU/UK representatives (if applicable). If Article 27 (EU/UK) applies, EXPLR will designate EU/UK representatives; details will appear in the Privacy Policy.

7. Cookies & Similar Technologies

We use cookies and similar technologies for essential functionality, analytics, and (where applicable) advertising. In regions requiring consent, we present a cookie banner and honor your choices. You may adjust preferences via the banner (where available) or your browser settings.

8. Resources, External Links & Opinions

The Website includes resources and links provided for user convenience. Inclusion does not imply importance, endorsement, or preference by EXPLR. Some materials may include the views/recommendations of independent subject-matter experts and may link to information created/maintained by other public or private organizations.
EXPLR does not control or guarantee the accuracy, relevance, timeliness, or completeness of any external information. Opinions expressed in linked or referenced materials do not necessarily reflect EXPLR’s positions or policies. Examples of resources or methodologies are illustrative only and do not constitute endorsements.

9. Listed / Partner Events (Global)

Events listed on the Platforms as part of EXPLR programming — including partner, affiliated, and associated events globally — may be independently organized and managed by third parties. EXPLR does not control the content presented at these events or on associated sites/social channels.
Attendance is at participants’ discretion. EXPLR is not responsible for event management or outcomes, including (without limitation) logistics, reservation systems, scheduling, delays, cancellations, changes to event details, personal injury, loss of items, or any other claims arising from participation. Review the specific terms and policies of each event before attending.

10. User Conduct

You agree not to: (a) violate laws or third-party rights; (b) upload/post content that is unlawful, infringing, or harmful; (c) attempt to access systems or data without authorization; (d) introduce malware; (e) interfere with Platform operation or users; (f) scrape or harvest data except as expressly permitted; or (g) circumvent technical measures.

11. Intellectual Property; Feedback

All trademarks, logos, and service marks displayed on the Platforms are the property of EXPLR or their respective owners. Nothing grants any license or right to use them without prior written permission.
If you provide feedback (ideas, suggestions), you grant EXPLR a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use it without restriction or compensation.

12. Submissions & Program Entries

If the Platforms enable submissions (e.g., student projects, applications, or media), those programs may have separate terms that govern eligibility, rights, and usage. In the event of conflict, the program-specific terms control for that submission.

13. Disclaimers

THE PLATFORMS AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPLR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORMS WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPLR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE PLATFORMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, THE TOTAL AGGREGATE LIABILITY OF EXPLR FOR ALL CLAIMS RELATING TO THE PLATFORMS SHALL NOT EXCEED US$100 OR THE AMOUNT YOU PAID (IF ANY) FOR ACCESS TO THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

15. Indemnification

You agree to defend, indemnify, and hold harmless EXPLR and its affiliates, and their respective officers, directors, employees, agents, and partners, from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms or your misuse of the Platforms.

16. Suspension & Termination

We may suspend or terminate your access to the Platforms at any time for suspected violations of these Terms, illegal activity, or to protect users, us, or third parties. Upon termination, the rights granted to you under these Terms will cease immediately.

17. Governing Law; Venue

These Terms are governed by the laws of New York State, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Kings County, NY for any dispute not subject to arbitration (if applicable). If you prefer arbitration/waiver of class actions, we can add that clause.

18. International Use

You are responsible for compliance with local laws. Accessing the Platforms from territories where the content is unlawful is prohibited.

20. Miscellaneous

If any provision is held unenforceable, it will be modified to the minimum extent necessary, and the remainder will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or asset sale. Headings are for convenience only.
